Acceptable Use Policy


This Acceptable Use Policy (AUP) applies to all persons and entities (collectively, "customers") using the products and/or services of CompuBasix, Inc., ("CompuBasix") including Internet service. The policy is designed to protect the security, integrity, reliability, and privacy of both the CompuBasix network and the products and services CompuBasix offers to its customers. CompuBasix reserves the right to modify this policy at any time, effective immediately upon posting of the modification. Your use of CompuBasix' products and/or services constitutes your acceptance of the AUP in effect at the time of your use. You are solely responsible for any and all acts and omissions that occur during or relating to your use of the service, and you agree not to engage in any unacceptable use of the service.

CompuBasix does not actively monitor nor does CompuBasix exercise editorial control over the content of any web site, electronic mail transmission, mailing list, news group or other material created or accessible over CompuBasix services. CompuBasix does however reserve the right to remove any materials CompuBasix does become aware of that are, in CompuBasix' sole discretion, potentially illegal, could subject CompuBasix to liability, or violate this AUP. Your violating this AUP may result in the suspension or cancellation of your CompuBasix services.

Dial-up Access

Dial-up connections are intended to be used on an as needed interactive basis and are in no way intended to be used as a continuious link to the Internet. If you often require numerous hours online we strongly recommend a "dedicated" connection for your Internet service.

Disconnect your modem from our service when you are not actively using it. Many PPP clients automatically send out packets at regular intervals whether you're at your computer or not, making it impossible for us to "time out" idle sessions. It's your responsibility to hang up your modem when you're not using it.

Do not run any kind of server for incoming telnet, ftp, WWW, etc. from the dial-up connection.

Any type of automated process meant to re-establish and/or maintain a dial-up connection to CompuBasix while you're away from your computer is prohibited. This includes, but is not limited to, such things as IRC bots, keepalives and auto-dialers.

Inactivity

In an effort to keep modem lines available, when not being used, dial-up connections will be disconnected automatically after 15 minutes of inactivity.

Inactivity is defined as periods when, through electronic means no activity is detected and the dial-up connection is apparently not being actively used by the customer. As noted above, electronic or mechanical means to maintain a connection or to avoid an inactivity disconnect are strictly prohibited.

Spamming

Sending unsolicited bulk and/or commercial messages over the Internet (known as "spamming"). It is not only harmful because of its negative impact on consumer attitudes toward CompuBasix, but also because it can overload CompuBasix' network and disrupt service to CompuBasix subscribers. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, CompuBasix has the discretion to determine from all of the evidence whether the email recipients were from an "opt-in" email list.

Intellectual Property Violations

Engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities. Also, engaging in activity that violates privacy, publicity, or other personal rights of others. CompuBasix is required by law to remove or block access to customer content upon receipt of a proper notice of copyright infringement. It is also CompuBasix' policy to terminate the privileges of customers who commit repeat violations of copyright laws.

Obscene Speech or Materials

Using CompuBasix' network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material. CompuBasix is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through CompuBasix' network.

Defamatory or Abusive Language

Using CompuBasix' network as a means to transmit or post defamatory, harassing, abusive, or threatening language.

Forging of Headers

Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.

Illegal or Unauthorized Access to Other Computers or Networks

Accessing illegally or without authorization computers, accounts, or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking"). Also, any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity).

Distribution of Internet Viruses, Worms, Trojan Horses, or Other Destructive Activities

Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mailbombing, or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service, or equipment.

Facilitating a Violation of this AUP

Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mailbombing, denial of service attacks, and piracy of software.

Usenet Groups

CompuBasix reserves the right not to accept postings from newsgroups where we have actual knowledge that the content of the newsgroup violates the AUP.

Other Illegal Activities

Engaging in activities that are determined to be illegal, including advertising, transmitting, or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards, and pirating software.

Other Activities

Engaging in activities, whether lawful or unlawful, that CompuBasix determines to be harmful to its subscribers, operations, reputation, goodwill, or customer relations.

Personal Web Space

CompuBasix provides free disk space to our dial-up customers to construct their own personal, non-commercial web page. Should a personal site become so popular that, in CompuBasix' sole opinion, it creates a substancial amount of traffic on our network, we do reserve the right to remove the site from our server.

By accepting an account with CompuBasix, the customer agrees that the customer shall be responsible and hold CompuBasix harmless of any liability arising out of customer's actions and the actions of customer's employees, agents or representatives. Failure to follow any of the above guidelines or the Terms and Conditions may result in suspension or termination of the customer's account, and in the event of violations of local, state or federal law or statute, civil and/or criminal proceedings may follow. CompuBasix will make reasonable effort to contact the customer in the event of a violation, however we reserve the right to terminate service without notice. CompuBasix will endeavor to resolve any disputes to the best of its ability but is under no obligation to do so in the event these guidelines are not followed.
